Nelnet Lawsuit and Settlement: Is It Real and Can You File a Claim?

The main Nelnet lawsuit is a $10 million class-action settlement over a 2022 data breach that exposed the personal information of approximately 2.5 million borrowers. The settlement is real, court-supervised, and administered through NelnetSettlement.com.

The 2022 Nelnet Data Breach and Settlement

In June and July 2022, an unauthorized third party breached systems at Nelnet Servicing, LLC — the technology and servicing platform behind Edfinancial Services and the Oklahoma Student Loan Authority (OSLA). Nelnet disclosed the breach on August 26, 2022.

The breach exposed names, addresses, email addresses, phone numbers, and Social Security numbers for about 2,501,324 borrowers.

Multiple class actions filed in August 2022 were consolidated in the U.S. District Court for the District of Nebraska as In re Data Security Cases Against Nelnet Servicing, LLC, No. 4:22-cv-03191 (D. Neb.).

The complaints alleged Nelnet failed to implement reasonable data security, exposing borrowers to identity theft and fraud.

Nelnet, Edfinancial, and OSLA denied liability but agreed to a proposed $10 million settlement fund to resolve the litigation. The settlement received amended preliminary approval on December 4, 2025. Final approval depends on the May 5, 2026 fairness hearing.

How the Nelnet Settlement Claim Process Works

The deadline to file was March 5, 2026 (11:59 p.m. ET for online submissions). Borrowers who missed the deadline are not eligible for cash payments or credit monitoring — even if their data was compromised in the breach. Class members who neither filed nor opted out remain bound by the settlement once the court grants final approval.

What Benefits the Settlement Covers

Borrowers who filed a timely claim could select from four categories of benefits. Eligibility covered U.S. residents whose data was compromised in the breach, typically confirmed through a mailed or emailed notice from the settlement administrator.

Credit monitoring

Two years of credit monitoring and identity-theft protection, including $1 million in identity-theft insurance. No documentation required beyond the claim form.

Out-of-pocket loss reimbursement

Up to $5,000 for documented losses caused by the breach, such as unreimbursed fraudulent charges, credit freeze fees, or identity-theft remediation costs.

Lost-time payment

Up to $100 (four hours at $25 per hour) for time spent addressing breach-related issues. Required a sworn description of the time spent — no itemized financial losses needed.

Pro-rata cash payment

A one-time payment from the remaining settlement fund after fees, expenses, and other benefits are paid. California residents who lived in the state at the time of the breach receive a 2× multiplier on this payment.

Because all payments come from a fixed $10 million fund, per-person amounts depend on how many claims were filed and which benefits claimants selected.

Stevens v. Nelnet Servicing, LLC (2024) Filed June 2024 in West Virginia federal court (No. 3:24-cv-00280, S.D.W. Va.). Alleges Nelnet miscalculated income-driven repayment amounts and reported inflated figures to credit bureaus. Pending — no settlement or claim process.

CARES Act misrepresentation lawsuit (2020) Alleged Nelnet misled borrowers about eligibility for pandemic-era relief. No open claim process.

Massachusetts Attorney General settlement (2024) A $1.8 million settlement over allegations that Nelnet failed to send adequate income-driven repayment renewal notices between 2013 and 2017. The payment went to the state, not to individual borrowers.
